The week in brief

Several exciting things happened this week!  First of all, the Obama Administration released “Memos of Law,” written by the Bush “Justice Department.”  We can all decide for ourselves how just and legal those memos are.  As for this lawyer, those memos are a perfect example of what whores lawyers can be when they forget that they are not just representatives of their clients – in this case the Bush Administration – but Officers of The Court, charged with protecting and defending the Constitution of the United States and of the State in which they practice.  The men who wrote those memos might as well have practiced in a fascist state.  They completely forgot where they lived and what our ethos, ethics, morality, and constitution require of us as Americans.  What is tragic is the wild numbers of lunatics who have written to defend the use of torture against our enemies.

Next the administration has extended a hand of friendship to Cuba, something that would have been done decades ago is it wasn’t for the formerly fanatic anti communist former Cubans living in Florida and their intense political lobby.  Fortunately, those people have grown old and their children aren’t fixated about what Cuba was like over 50 years ago.  This could have been done by either Clinton or Bush but they were both terrified of losing the votes of the former Cuban refugees and their children.  Thank G-d for the passage of time.

I have also been shocked, shocked, to learn that an investigation into the dealings of former New York State Legislator, Alan Hevesi, has revealed the degree to which companies must pay off politicians to do business with the State of New York.  LOL.

Ah yes, it is obvious that the markets are recovering and they are getting fat and happy.  Also LOL.  The lemmings that reside in the market will shortly spook when additional bad news comes out of the economy, but for now the band on the Titanic is playing for all its worth.  The big banks (note the intentional small case letters) are making money again due to humongous infusions of the peoples money and they are still being run by the crew that raped America in the first place.  What a nutty country this is.

There are some good things: Paul McCartney is still playing the guitar in public.

    “Then I beheld a thousand faces, made / Purple with cold; whence o’er me comes a shudder, / And evermore will come, at frozen ponds.”

    The torture the U.S. may or may not have inflicted on these murderers is nothing compared to the frozen hole in Caina awaiting them. There no one will be able to appeal their fate of eternal frozen damnation for the crimes they have committed on this Earth.

    As the elder Friedlander accurately point out, those which stand against the United States, formerly known as “enemy combatants,” around the world should not be held indefinitely. By proximity and association of the U.S. military, those “members of the loyal opposition,” as they will be referred to throughout this treatise have rights: rights to habeas corpus, right to a speedy and public trial, right to an attorney and freedom from cruel and unusual punishment.

    Then we as a nation, as citizens of the world, have an obligation to stand against the absolute tyranny being meted out by the President of the United States Barack Obama, who is using lethal, covert operations to snuff out those “members of the loyal opposition” currently boycotting and protesting global trade agreements and global warming in the Gulf of Aden.

    Currently, there are “members of the loyal opposition” doing all they can to bring in camera the destructive power of most favored nation trading status both to their own nations and the globe. Trade between rich nations such as the United States and China is leaving out valuable opportunities for benevolent governments to protect limited wealth and resources in nations such as Somalia. Somalia, with an abundance of sand, could play a crucial role in the world’s construction boom through the production of glass and concrete. Yet, the United States and China seek cut Somalia out of all trade agreements, while simultaneously flaunting their wealth sailing their nations’ yachts within a close radius of the Horn of Africa.

    Further, these “pleasure boats of the rich world” as killing the very atmosphere which protects the helpless people of Somalia through the release of such noxious byproducts as carbon dioxide and dihydrogen oxide – an odorless, tasteless killer.
    Acting in the best interest of their people, and the citizens of the world, “members of the loyal opposition” have sought to neutralize these vessels, through the two pronged approach of docking the vessels at the nearest port and confiscating a tax on the ships’ owners to equalize the unfair exclusive trade agreements and the destruction to the environment. In the parlance of the global environmental movement, this is known as a “carbon-neutralization tax.”

    Most nations are happy to pay the necessary taxes when approached by the “members of the loyal opposition,” but after the United States’ bloody example, I fear we are in for a violent end to this practice.

    On April 8, “members of the loyal opposition” were enjoying the warm breezes an early spring day brings to the Eastern coast of Africa. They had but one task on this sunny day, approach the United States flagged “pleasure boat of the rich world” Maersk Alabama piloted by Richard Phillips and ask for the payment of Somalia’s “carbon-neutralization tax.” Captain Phillips though, believing he to be above the law, refused. The “members of the loyal opposition” then entered into a protracted negotiation without the pilot of the ship and the United States government’s agents in the region, the U.S. Navy, to determine a fair and equitable payment of the “carbon neutralization tax.”

    Negotiations were ongoing until early in the morning of April 12, Easter on the Christian calendar, when Barack Obama, on the way to observe Easter festivities at his Christian church, gave the executive order to his agents, the U.S. Navy, to assassinate the Muslim “members of the loyal opposition” to bring a swift conclusion to the negotiations.

    What follows was a brief but bloody encounter in which three of the four Muslim “members of the loyal opposition” were gunned down by Barack Obama’s marksman. The fourth, 16-year old Muslim Abde Wale Abdul Kadhir Muse, was captured and is currently awaiting trial in a United States Kangaroo court.

    So, in the world which the elder Friedlander has presented to us, one in which “members of the loyal opposition” are to be granted the same rights as U.S. citizens by association with the United States military what are the implications of the Obama administration ordering the execution of “members of the loyal opposition” without a proper trial? Why was only one “member of the loyal opposition” granted the privilege of a court trial, while his colleagues were gunned down in cold blood by Obama’s secret police goons? And now that it has been revealed that this lone survivor of Obama’s apparent genocide is a 16 year old, what right does the United States have to try him as an adult?

    Indeed, what of the poor young Abde Wale Abdul Kadhir Muse whose mother has pleaded for his release. As she told the BBC news, “I am requesting the American government; I am requesting President Obama to release my child. He has got nothing to do with the [member of the loyal opposition’] crime. He is a minor; he is under-age and he has been used for this crime.” Perhaps young Abde Wale Abdul Kadhir Muse is the lucky one. Of course, the other “members of the loyal opposition” will not have their day in court. Their voices have been muffled by the silenced barrel ends of Obama’s Navy. Dead men tell no tales, and they certainly have no right to a fair trial.

    From the evidence presented, it would appear the U.S. is being led by a ruthless tyrant who will use the white flag of peace to lure foes in closer, only to order their execution at the first sign of weakness. Are we as a nation going to stand for this abortion of justice? Do international waters give Obama the right to simply execute those which he has a disagreement with and detain the innocent children caught on the wrong side of a yachting holiday in the Indian Ocean?

    NO! We as a nation must stand up against the face of absolute tyranny. The high seas should not be ruled by Barack’s bloody fist. Since Obama issued an executive order authorizing the cold-blooded murder of these innocent human beings, he should be brought before The Hague to answer for his crimes immediately.

    Demand justice! Revenge the “members of the loyal opposition” who were wrongfully murdered! Bring Obama to trial immediately. We cannot live in a world ruled by fear.

    How are youth “tried” as adults?1

    There are five major ways that youth can be prosecuted in adult court:

    Judicial Waiver

    45 states allow juvenile court judges the discretion to have a youth’s case tried in the adult criminal court.

    Direct File or “Prosecutorial Discretion”

    15 states allow prosecutors the discretion to have a youth’s case tried in the adult criminal court.

    Mandatory Waiver

    15 states require juvenile court judges to automatically transfer a youth’s case to adult criminal court for certain offenses or because of the age or prior record of the offender.

    Statutory Exclusion

    29 states automatically require a youth’s case to be tried in the adult court based on the age of the youth or the alleged crime or both.

    Age of Majority Statutes

    Three states—Connecticut, New York, and North Carolina—automatically prosecute 16- and 17-year-olds as adults. Ten states—Georgia, Illinois, Louisiana, Massachusetts, Michigan, Missouri, New Hampshire, South Carolina, Texas, and Wisconsin—automatically prosecute 17-year-olds as adults.2

    How many youth are tried as adults?

    Despite the fact that many of these state laws were intended to prosecute the most serious offenders, most children who are tried in adult courts are there no matter how minor their offense.
    Estimates range on the number of youth prosecuted in adult court nationally. Some researchers believe that as many as 200,000 children are prosecuted every year.

    How does “trying youth as adults” affect youth?

    Youth tried in the adult criminal court:

    Face the same penalties as adults, including life without parole;

    Will receive little or no education, mental health treatment, or rehabilitative programming;

    Will obtain an adult criminal record that may significantly limit their future education and employment opportunities;

    Are at greater risk of assault and death in adult jails and prisons with adult inmates; and

    Will be more likely to re-offend than youth not exposed to the negative influences and toxic culture of the adult criminal punishment system.

    You may not like it, but for many crimes youths are tried in Adult Court; it depends upon the state in question.
